Me Anas Qiabi, accredited arbitrator ("we", "us"), is committed to protecting the personal information of individuals who visit qiabi.ca or submit an inquiry through the contact form. This Privacy Policy is established in compliance with Quebec's Act respecting the protection of personal information in the private sector (RLRQ c P-39.1), as amended by An Act to modernize legislative provisions as regards the protection of personal information (S.Q. 2021, c. 25, commonly referred to as "Law 25"), and with the federal Personal Information Protection and Electronic Documents Act (PIPEDA, S.C. 2000, c. 5), to the extent it applies.
1. Identity and Contact of the Person Responsible
The person responsible for the protection of personal information within the meaning of Law 25 is Me Anas Qiabi. For any question, request, or complaint regarding the handling of your personal information, you may contact him directly at: [email protected]. We will respond to any written request within 30 days of receipt.
2. Information Collected and Purpose
We collect only the personal information that is necessary for the specific purposes for which it is collected, in accordance with the principle of minimization. When you submit the contact form, we collect: your name, email address, your role in the dispute (counsel for a party, self-represented party, arbitration institution, or other), the stage of the proceedings, the names of parties, the counsel and firm of each party (for conflict-of-interest verification purposes), the nature of the dispute, the approximate amount in dispute, and any description you choose to provide. This information is collected exclusively for the following purposes: (a) to evaluate whether a potential arbitration mandate can be accepted; (b) to conduct a conflict-of-interest check as required by applicable professional rules; and (c) to respond to your inquiry. We do not collect personal information for any other purpose without your prior consent.
3. Legal Basis and Consent
The collection of your personal information is based on your voluntary consent, expressed by submitting the contact form. You may withdraw your consent at any time by contacting us at [email protected], subject to legal or contractual restrictions and reasonable notice. Withdrawal of consent may limit our ability to respond to your inquiry or evaluate a potential mandate.
4. Confidentiality and Non-Disclosure
Your personal information will not be sold, rented, or disclosed to third parties, except: (a) as required by law or by order of a competent authority; (b) as required by the professional rules of the Barreau du Québec or applicable arbitration institutions; or (c) with your express prior consent. All information received in connection with a potential or active arbitration mandate is subject to strict professional confidentiality.
5. Data Retention
Personal information is retained only for as long as necessary to fulfill the purposes for which it was collected, and to comply with applicable legal and professional obligations. Once the information is no longer required, it is destroyed or anonymized in a secure manner. Inquiries that do not result in a mandate are generally retained for a period of one (1) year for conflict-of-interest tracking purposes, after which they are securely deleted.
6. Security Measures
We implement reasonable technical and organizational security measures to protect your personal information against unauthorized access, disclosure, alteration, or destruction. These measures are proportionate to the sensitivity of the information and the risks involved.
7. Cookies and Tracking Technologies
This website uses cookies that are essential to its operation and, only with your consent, audience-measurement cookies (Google Analytics). No advertising cookies are used. The following cookies may be set: (a) __cf_bm — set by Cloudflare, Inc. for security and anti-bot protection; strictly necessary; expires approximately 30 minutes after your session; (b) Google Analytics cookies — set only if you click Accept on the cookie consent banner; deactivated by default. You may withdraw your consent to analytics cookies at any time by clicking Decline on the banner or by contacting us. Standard server logs (IP address, browser type, pages visited, date and time of access) may be retained for security and operational purposes for a limited period. These logs do not identify you personally and are not used for profiling or marketing purposes.
8. Your Rights Under Law 25 and PIPEDA
In accordance with Quebec's Act respecting the protection of personal information in the private sector (RLRQ c P-39.1, as amended by Law 25) and PIPEDA, you have the following rights with respect to your personal information held by us: (a) Right of access — to obtain confirmation of whether we hold personal information about you and to receive a copy; (b) Right of rectification — to request the correction of any inaccurate, incomplete, or ambiguous information; (c) Right to erasure — to request the deletion of information collected, communicated, or used contrary to law, subject to applicable retention obligations; (d) Right to withdraw consent — to withdraw your consent to the collection or use of your information at any time, subject to legal or contractual restrictions; (e) Right to lodge a complaint — to file a complaint with the Commission d'accès à l'information du Québec (CAI) at www.cai.gouv.qc.ca, or with the Office of the Privacy Commissioner of Canada at www.priv.gc.ca. 9. Cross-Border Transfers
The site and the contact form are hosted by GoDaddy, whose servers and request-management systems are located in the United States. The information you send through the form is therefore kept outside Québec. A privacy impact assessment was carried out before entrusting this information to that provider. The site is also served through Cloudflare, Inc. (content delivery and security), whose infrastructure may process visitors' IP addresses and other technical data outside Québec. Audience-measurement data, if you consent to it, is processed by Google, which may also host it outside Québec.
10. Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. The date of the most recent revision appears at the top of this page. We encourage you to review this page periodically.
