Arbitration Mandate
Me Qiabi accepts mandates as sole arbitrator or as a member of a panel, in French and English. The following steps outline what is required to open a file.
How to Open a Mandate
Four steps are required before a mandate can be accepted.
Provide the arbitration clause, the arbitration agreement, or the statutory or regulatory provision on which the arbitration is based. If the clause gives the appointment of the arbitrator to an institution, the appointment follows that institution's rules (see 'Administered arbitrations' below).
Fees & Engagement
$275 / hour
hourly rate
Me Qiabi's hourly rate is $275*. A deposit is required when each file is opened, together with the signature of an arbitration protocol to be determined after review of the file. The scope and terms of the mandate are confirmed in writing before the proceedings begin.
* Taxes and disbursements extra. The rate applies to all time spent on the file from the appointment onward: case management conferences, review of the file, hearings, deliberation and drafting of the award. Subject to the arbitration clause and to any agreement between the parties, fees and disbursements are borne in equal shares. This rate applies to ad hoc arbitrations; in an arbitration administered by an institution, the arbitrator's remuneration follows that institution's tariff.
Administered arbitrations
Where the clause refers to an arbitration institution, the appointment of the arbitrator follows that institution's rules. Me Qiabi is an accredited arbitrator with the CCAC, SORECONI and IMAQ; depending on the applicable rules, the parties may propose his appointment to the institution, or the institution may designate him. Under the guarantee plan for new residential buildings, the arbitrator is designated by the institution.
